Program Overview

 

The flagship benefit of the Bacio Gold Club is the Bacio Cash-Back Rewards Program, featuring the Bacio Visa® Reward Card (the “Visa Reward Card”), which helps pizzerias grow their business with cash-back savings. For every pound of Bacio® Cheese purchased, pizzerias in the Bacio Gold Club earn a $0.06 back in Bacio Cash-Back Rewards. Rewards are issued monthly with a Visa® Reward Card.

Your Visa Reward Card is subject to all rules, policies and procedures of the Bacio Gold Club Visa Reward Card Program as set forth herein (“Program Rules”). Acceptance and/or use of this card conclusively indicates cardholder’s agreement to abide by the Program Rules as may be changed by Bacio from time to time. You may not use any of Bacio or its affiliates’ trademarks or service marks or other intellectual property (collectively “Marks”) for any purpose. The Visa Reward Card does not grant you any license of any kind or nature nor any other right to use the Bacio trademark or the Marks. The Visa Reward Card cannot be returned to Bacio nor will Bacio provide any refunds or be liable for any Reward Card that remains undistributed or unused.

By accepting and/or using a Reward Card, you agree that you will comply with the Program Rules, the Cardholder Terms and Conditions (as defined below) and all applicable laws and regulations. You agree that you will not use the Reward Card in any manner that is illegal, misleading, deceptive, harmful to consumers, or otherwise negatively impacts the goodwill associated with Bacio, its affiliates, or the Marks. You agree to indemnify Bacio and hold Bacio harmless from any and all claims, expenses or liability that may arise in connection with your use of the Reward Card or any violation of any of the Program Rules and/or these Terms and Conditions. Any dispute between you and Bacio or any of its affiliates, or their respective officers, directors, employees, shareholders, members, managers or authorized agents, will be governed by and determined exclusively in accordance with the substantive laws of the State of Colorado, which laws will prevail in the event of any conflict of law.

Your Visa Reward Card is issued by CenterState Bank of Florida, NA pursuant to a license from Visa U.S.A Inc. Your ownership and use of the Visa Reward Cards is governed by the Visa Reward Card Terms and Conditions attached hereto (“Cardholder Terms & Conditions”). Any dispute arising out of, or in any way related to, the Reward Card shall be governed by the Cardholder Terms and Conditions.


BACIO RESERVES THE RIGHT TO TERMINATE THE BACIO REWARD CARD PROGRAM AND/OR CHANGE THE PROGRAM RULES FROM TIME TO TIME IN ITS SOLE DISCRETION WITHOUT NOTICE.

To qualify for the Bacio Gold Club, customers must purchase Bacio Cheese for four consecutive weeks. Must purchase at least 400 pounds each month to receive Reward Card monthly.

Visa® Reward Card Terms and Conditions

These are your Visa Reward Card (“Card”) Program terms and conditions. Please read them carefully and retain them for your records. Please sign your Card immediately. By accepting and retaining the Card, signing the Card, and using the Card, you accept and agree to be bound by these terms and conditions. This Card is a “stored value” card and is not a credit card or an FDIC insured deposit account. This Card is issued by CenterState Bank of Florida, NA pursuant to a License from Visa U.S.A.,Inc. In these terms and conditions, “you” and “your” refers to the person who has received the Card; “we”, “us” or “our” refers to CenterState Bank of Florida, NA, our successors, affiliates, assigns and processors. These terms and conditions are subject to change without notice and supersede any and all previous terms and conditions.

Reward Program: Cards are sold to businesses (“Purchaser”) directly. Purchaser can distribute the Cards to employees or clients in furtherance of specific business goals and objectives. The Card has a preloaded stored value balance. You acknowledge that you have not paid value for the Card you have received.

Card Usage: Your Card must be activated prior to use. Please see activation instructions on the card carrier included with your card. Your Card may be used for purchases at all merchants equipped with a point-of-sale terminal that can process Visa transactions. Purchases and service charges will be deducted from your Card balance until the stored value reaches zero. Non-reloadable Cards cannot be re-used after the Card value has been exhausted.

Card Access: The Reward Card is a prepaid card that can be used anywhere Visa debit cards are accepted worldwide and as a Visa point-of-sale transaction. If applicable with your purchase, the Reward Card may also be used with a personal identification number, issued to you when your card is activated, at Interlink® and Cirrus ATM locations. If the Reward Card does not bear the Interlink logo, your Card cannot be used for cash access or at any ATM. Cash access is not permitted on non-reloadable Visa cards unless cardholder information is on file.

Conversion to U.S. Dollars: Card transactions made in currencies other than U.S. Dollars will be converted to U.S. Dollars. The exchange rate for transactions in a foreign currency will be a rate selected by Visa U.S.A., Inc. from the range of rates available in wholesale currency markets for the applicable central processing date and may vary from the rate Visa U.S.A., Inc. itself receives or the government-mandated rate in effect for the applicable central processing date. All transactions in foreign countries will be subject to a fee of $2.00 plus 3% of the purchase value.

Card Value: You may only use a Card when there is a balance remaining on the Card and only up to the value left on the Card. If your purchase amount is greater than the value on your Card, inform the merchant before presenting the Card. Depending on the policy of the merchant, the difference may be paid with another form of payment. Any transactions that are attempted after the Card value has been exhausted will be declined. If you improperly receive value greater than the remaining balance on your Card for any reason, you will be liable for the amount by which your transaction(s) exceeds the remaining balance. After the Card value has been exhausted, please destroy your Card by cutting the Card across the magnetic strip on the back as well as the raised numbers on the front. Expired cards have no value.

Service Charges: This Reward Card is part of a reward, incentive or loyalty program. We do not charge monthly maintenance fees. To receive a replacement card, contact the purchaser of the Card. Your Card expires on the Good Thru date printed on the front of the Card, at which time funds will no longer be available. If applicable, maximum ATM withdrawal is $150.00 per day. All transactions in foreign countries will be subject to a fee of $2.00 plus 3% of the purchase value.

Limitations on Transactions: Your Card is nontransferable. Do not give your Card to anyone else to use. You agree not to use your Card for transactions that exceed the amount of funds stored on your Card. You are responsible for all authorized transactions initiated by use of your Card. You may not make pre-authorized regular payments through the use of your Card.

Card Balance: To check your Card balance you can call us toll free at 1-877-357-4975 or visit www.omnicard.com/cards/activate.

Lost/Stolen Cards: We are not responsible for lost or stolen Cards, and we have no ability to identify the person using a Card at the point of purchase. If your Card is lost or stolen, please contact the purchaser to inquire about obtaining a replacement Card prior to the Card’s expiration date. Keep a record of your Card number in a safe place, separate from the Card. If requested by purchaser only, any remaining balance after the Card will be re-issued to you on a replacement Card.

Error Resolution Procedures: In case of errors or questions about transactions arising from the use of your Card, call us at 1-877-357-4975 or write to: WRL, LLC, 495 Mansfield Ave., Pittsburgh, PA 15205. We must hear from you within 60 days of the date of the transaction in question. You will need to provide the following information: a) your name and Card number; b) the dollar amount of the suspected error and approximately when the error took place c) description of the error and explain why you believe there is an error.

Amendment: We can change these terms and conditions, including all fees, at any time, and such changes will be binding on you. If required by law, we will give you written notice of the change prior to the effective date of the change. However, if the change is made for security purposes or as a result of changes in fees, changes of costs imposed by any party other than us, we can implement it without prior notice. Your use of the Card constitutes acceptance of any amendment implemented by us.

Disclosure of Information to Third Parties: Information about the Card or transactions may be disclosed to and by third parties on our behalf in the following situations: where necessary to complete the transaction (e.g. to verify the existence and condition of your Card to a merchant); or to comply with government agency or court orders or as otherwise required by law or in connection with examinations by banking authorities; or for analytical purposes; or with your permission.

Governing Law: These terms and conditions will be governed by Federal Law and where not in conflict with Federal Law, the laws of the State of Florida, without regard to conflict of law principles. Whenever possible, each provision herein shall be interpreted in such a manner to be effective under applicable law, but if any provision is held to be invalid, illegal or unenforceable under any applicable law or rule, the validity, legality and enforceability of the other provisions herein will not be affected or impaired thereby. These terms and conditions, or any portion thereof, shall be VOID WHERE PROHIBITED BY LAW

Arbitration: Any controversy or claim arising out of or relating to these Terms and Conditions or the provision of services shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. Any such controversy or claim shall be arbitrated on an individual basis and shall not be consolidated in any arbitration with any claim or controversy of any other party. The arbitration shall be conducted in the State of Florida, and judgment on the arbitration award may be entered in any court having jurisdictions thereof. Either you or we may seek any interim or preliminary relief from the court of competent jurisdiction in the State of Florida necessary to protect the rights of property of you or us (or our agents, suppliers, and subcontractors) pending the completion of the arbitration.

Important Usage Tips for your Card:

•    When shopping, simply tell the cashier to process your card as a “credit” transaction, not a “debit” transaction.

  • To purchase gas, have the station attendant process the transaction inside.
  • With transactions canceled at the register, a temporary hold may be placed on the funds for seven days.
  • Some merchants, including most restaurants and service establishments, have a policy of authorizing an amount up to 25% more than your total purchase in order to cover any outstanding tip or gratuity.
